With the consent of the learned counsel for the parties, the matter is heard finally.

Learned counsel for the petitioner would submit that despite there being an order passed by the Director, Horticulture, Regional Forestry, Raipur on 02.03.2015, the petitioner is not allowed to join at

Government Horticulture Nursery, Pandaripani, Block Katghora, District Korba.

Considering the order passed by this Court in WPS No.21/2015 and the consequential order passed by the above stated Director on 02.03.2015 (Annexure-P-1), the writ petition is disposed of with a direction that in the event, the petitioner submits representation for joining before the respondent No.4 i.e. Superintendent of Garden, Government Nursery, Pandaripani, Block Katghora, District Korba, the said officer shall either allow the petitioner to join or pass a reasoned order informing the petitioner as to why he cannot be allowed to join at Pandaripani.

It is made clear that this Court has not expressed any opinion on the merits of the case and the respondent authorities shall decide the matter, on its own merits, strictly in accordance with law, without treating any observation made in this order, as opinion on the merits of the case.
