Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 8/10/2015 Heard finally with the consent of learned counsel for the parties. (2) By the impugned order, the petitioner has been rationalized and posted from Sub Health Centre, Usaribod, Ghumka to Sub Health Centre, Bhandarpur, Khairagarh.
(3) Learned counsel for the petitioner would submit that at Usaribod Sub Health Centre, the petitioner was the only Female Health Worker,
therefore, on her transfer, the post of Female Health Worker would remain vacant. The villagers have also raised protest against the petitioner's transfer and have made request for its cancellation. (4) In the considered opinion of this Court, rationalization posting has inbuilt administrative exigency, wherein, the Doctors and other employees working in the Health Department are posted at such places where there is shortage of Doctors or staffs and their presence is required. The impugned exercise is purely administrative in nature and the writ Court does not interfere in such administrative exercise. (5) In view of the foregoing, the writ petition fails and is hereby dismissed.
