The grievance of the petitioner is that though the petitioner had been regularized on 09.09.2008 vide Annexure P/1, but the regular pay-scale has not been provided to him.

It is stated that one more person Anjor Das was also regularized by the same order and he was given the regular pay-scale as per Annexure P/10. As such the petitioner submits that he may be permitted to make a representation to the respondent No.3-Assistant Commissioner to decide the case of the petitioner, as the similarly placed other persons have been given the benefit of regular pay-scale.

The counsel for the petitioner relies the decision of the WPS No. 1138/2016 decided by this Court on 18.04.2016. The order reads as under:

"4. Accordingly, the writ petition is disposed of with a direction to the petitioners to approach the respondents within a period of two weeks from today by making a detailed representation in respect of their claim along with documentary proofs, if any and on receipt of the same, the Authorities concerned shall take a prompt decision taking into consideration the benefits which have been granted to the similarly placed persons.

5. This court has not expressed any opinion on the merits of the case the authority concerned is free to decide the representation of the petitioners on its own merit in accordance with law." 4.

It is ordered accordingly. The petitioner if makes the representation within a period of two weeks, the same shall be decided by the respondent No.3Assistant Commissioner in view of the observations made herein above as early as possible.

With the aforesaid observations, the present writ petition stands disposed off.
