1. Heard on I.A. No. 1/2017 for condonation of delay in filing instant MCC as the same has been filed after 15 days of its limitation.

2. On due consideration, for the reasons mentioned in the I.A. No. 1/2017, this court is of the view that the applicant has satisfactorily explained the cause of delay in filing the MCC. Hence I.A. No. 1/17 is allowed. Delay is condoned.

3. Also heard the matter finally.

4. Instant MCC is filed for restoration of MCC No. 899/2015 which was dismissed for want of prosecution vide order dated 3-112016.

5. On due consideration, MCC is allowed. MCC no. 899/2015 is restored to its original number.

6. No order as to costs.
