Aggrieved by the impugned order Annexure P/1 dated 08.09.2021 the present writ petition has been filed. Vide the impugned order the petitioner's services have been placed under suspension on allegation of serious complaints.

At the outset, this Court is of the opinion that the impugned order is an appealable order under Rule 23 of the Civil Services (Classification, Control & Appeal) Rules, 1966. It appears that the petitioner has not preferred and has straight away approached this Court assailing the order of suspension.

Given the fact that the order is an appealable order and the petitioner has not preferred any appeal, the writ petition at this juncture stands disposed of permitting the petitioner to prefer a departmental appeal before the Appellate Authority ventilating his grievances. On such appeal being preferred, the Appellate Authority is expected to take a decision within a period of 45 days from the date of receipt of the copy of this order.

With the aforesaid observations, the present writ petition stands disposed of.
