1. Petitioner is aggrieved by the order of suspension, issued by the Executive Engineer (City-East) CSPDCL, Bhilai.

2. Shri Gaharwar, learned counsel appearing for the respondents, on advance notice, would submit that the order is appealable before the Superintendent Engineer.

3. In Union of India and Others v. Major General Shri Kant Sharma and Another1, the Supreme Court has held that when statutory remedy is available, High Court should not entertain the petition.

4. In view of the aforesaid proposition of law, the writ petition is dismissed as not maintainable with liberty in favour of the petitioner to avail the alternative remedy, in accordance with law. It is expected that the appeal be decided expeditiously.
