(1) The petitioners earlier filed a writ petition being W.P. (S) No.4239/2011 for issuance of direction to respondent No. 2 to consider the petitioner's case for dependent employment.

(2) This Court by order dated 14.09.2011 disposed of the writ petition directing the respondent No. 2 to consider the representation of the petitioner for dependent employment within a period of three weeks from the date of order in accordance with law.

(3) Learned counsel for the petitioner would submit that since the representation of the petitioner has not been considered & decided till now, therefore, the instant writ petition has been filed. (4) The first writ petition filed by petitioner was disposed of with certain directions. Accordingly for the petitioner, those directions are not being

complied by the respondents. The petitioner is at liberty to proceed for noncompliance of order against the respondents therein. However, petitioner will not be allowed for maintain the second writ petition on the same cause of action. The petitioner as well as the respondents both have to respect of the order of Court, as such, second writ petition is not maintainable on the ground of public policy (5) Accordingly, the petition is dismissed as not maintainable.
