This is an application for appointment of Arbitrator on the ground that earlier Shri Justice N.K.Agrawal (Retired) was appointed as Arbitrator and thereafter he has assumed some office, therefore, he cannot continue as Arbitrator further.

It is submitted by the parties that the statement of claim and reply has been filed and the case is fixed for framing of issues. 3.
Learned counsel for the applicant suggests the name of Advocate Ms. Sharmila Singhai to arbitrate the matter, which is not opposed by the learned State counsel.

Ms. Sharmila Singhai, learned counsel, who is present in the Court also extended willingness to act as a sole arbitrator.

Accordingly, Ms. Sharmila Singhai, Advocate, is appointed as Arbitrator to decide and consider the claim preferred by either side.

The remuneration shall be settled by the parties with the consent of the Arbitrator.
7.
The Arbitrator who is present in the Court shall further notify the parties with the date of hearing.
8.
With such observation, the instant arbitration application stands disposed off.
