Regional Transport Authority, Bilaspur (Chhattisgarh) ---- Respondent For Petitioners Mr. Santosh Gupta, Advocate For Respondent/State Mr. Bhaskar Pyasi, Panel Lawyer Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 26/10/2015 Heard (2) The grievance of the petitioner is that on 27.05.2015 (Annexure P/1), the petitioner moved an application before the respondent for change of timing of regular permit No.3597/B/2010 on the route Jashpur to Sakti and one return trip daily, However, till date, the same has not been decided by the respondent.

(2) Learned counsel for the petitioner submits that this petition may be disposed of with a direction to the respondent to decide the said application expeditiously.

(3) Learned counsel for the State would submit that the regular

stage carriage permit issued in favour of the petitioner was valid and operative only till 30.09.2015, therefore, the writ petition is not maintainable.

(5) Considering the submission made by learned counsel for the petitioner and the objection raised by the learned State Counsel, the writ petition is disposed of with a direction that in the event, the petitioner's regular stage carriage permit is still in operation, the respondents shall decide the petitioner's application dated 27.05.2015 seeking change in time at the earliest preferably within a period of 8 weeks from the date of receipt of copy of this order. It is made clear that this Court has not expressed any opinion on the merits of the application and the Regional Transport Authority, Bilaspur shall decide the application on its own merits after giving notice and hearing the other permit holders operating on the route.
