1. The challenge in the present writ petition is to the order of transfer (Annexure P/1) dated 31.07.2018, whereby the petitioner has been transferred from Rajnandgaon to Balod.

2. The only ground of challenge by the petitioner in the present writ petition is that the petitioner is seriously suffering from ANKYLOSING SPONDYLOSIS WITH AVN RT. HIP.

3. According to the petitioner, the condition of the petitioner is that his body below the hip is totally immobile and he finds it difficult in movement and under the said circumstances he needs constant medical attention and also has to go for a hip replacement and therefore the petitioner for the moment may not be disturbed from his present place of posting.

4. Be that as it may, subject to the verification of the contention raised by the petitioner, if the petitioner makes a suitable representation to the

respondent No.1 in this regard supported with all relevant documents and certificates to his immediate superior officer within 15 days, the respondent No.1 shall in turn further consider the representation of the petitioner within a further period of 45 days. Till the representation is so decided, the respondents shall not give effect to the order of transfer (Annexure P/1), so far as the petitioner is concerned.
