After some arguments on admission, Learned counsel for the Petitioners submits that the instant Writ Petition (227) may be disposed of with liberty to make a prayer before the trial Court after furnishing his written

statement for framing the issues on the basis of the pleadings of both the parties and to press the issues framed on the basis of the pleadings of the Petitioner, which is the subject matter of the instant WP (227) to be heard and disposed of as a preliminary issue.

On due consideration, the instant WP (227) is disposed of and the Petitioner shall be at liberty to make a prayer before the trial Court for raising preliminary issues framed on the basis of the pleadings of the Petitioner in the Written Statement and the same may be heard and disposed of as preliminary issues as per law.
