1. This is first bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No. 4 of 2017 registered at P.S. Bagicha, Distt. Jashpur (C.G) for the offence punishable under Section 306 IPC.

2. As per the prosecution case, the applicant was married to Pooja Singh in the year 2011 and it is alleged that she was subjected to torture for not brining various house hold items. The applicant also used to humiliate her that she was childless (Banjh) and was not able to bear the child and because of the abetment the deceased committed suicide.

3. Learned counsel for the applicant would submit that the applicant has been falsely implicated in this case; he has not committed any offence of abetment and out of frustration the deceased herself has committed suicide because she was not able to bear a child.

4. Per contra, learned State Counsel opposes the bail.

5. Perused the case diary and statements of mother Lalita Devi and friend Renuka Lakda. Considering the statements of witnesses and the fact that the charge sheet has been filed and no further investigation is necessary in this case, I am inclined to allow this bail application.

6. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on executing a personal bond in sum of Rs.25,000/- with one surety each in the like sum to the satisfaction of the concerned trial Court for his appearance.
