The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 49/2016 registered in Police Station Sukma, Distt. Sukma (CG) for offence punishable under sections 376, 494, 506/34 of I.P.C.

As per the prosecution case, a report was made by the victim on 4/08/2016 that the applicant though was married pretended to be unmarried and on 10/02/2016 performed marriage with the complainant and sexually exploited her and further returned back to his earlier wife and when objected extended threat that her nude pictures will be made public. Thereby, offence has been committed.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case, after the marriage about 6 months report has been made. He submits that complainant is a major lady aged about 28 years and she was a consenting party to the entire incident,

therefore the applicant may be released on bail. 4.

Learned State counsel opposes the prayer for grant of bail. 5.

Perused the statement of the victim and the written report. Considering the facts and circumstances of the case, without further observation on the merits, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
