Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 13/01/2021

1. This is an application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with Crime No.138 of 2020, registered at Police Station Bastar, Distt Bastar C.G., for the offence punishable under Section 376 of the I.P.C.

2. Case of the prosecution, in brief, is that applicant has sexually exploited the prosecutrix on pretext of marriage. However, after knowing that she is carrying pregnancy of about six months, the applicant left the prosecutrix and

MCRC No. 7685 of 2020 refused to marry.

3. Considering the nature of allegation and conduct of the applicant, I am not inclined to release the applicant on bail.

4. Accordingly, the bail application is rejected. However, reserving liberty in favour of the applicant to revive the prayer after examination of the prosecutrix.
