Hon'ble Shri Justice Rajendra Chandra Singh Samant Order On Board /10/2021 1.

This petition has been brought praying for issuance of direction to the Court concerned for expeditious trial against the petitioner. 2.

It is submitted that charge-sheet has been filed against the petitioner on 18.12.2020. After framing of charges against the petitioner, the case is pending for recording of evidence of prosecution witnesses. Number of dates have been fixed for appearance of the witnesses, for which notices

were issued but the witnesses are not appearing. The petitioner has special interest that his case should be concluded as early as possible, therefore, issuance of direction is prayed for. 3.

Considered on the submissions. After perusing the documents filed along with the petition, this Court is of the view that the learned Court below is taking up the case for hearing regularly and all steps have been taken for the appearance of the witnesses. As it is submitted that witnesses are not appearing despite service of summons in that case, the learned trial Court has to take coercive steps against such witness, hence, this petition is disposed off at motion stage. The learned trial Court is directed to take coercive steps against erring witness and make all efforts to complete the trial against the petitioner within a period of one year.

Accordingly, this petition is disposed off.
