1. Heard.

2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.325/2020 registered at Police Station Balod (CG) for the offence punishable under Sections 420, 376(2) (<) of the IPC.

3. After arguing for sometime, learned counsel for the applicant seeks permission of the Court to withdraw the bail application with liberty to revive the prayer after examination of the

MCRC No. 7841 of 2020 prosecutrix.

4. Accordingly, the bail application is dismissed, as withdrawn with the aforesaid liberty granted to the applicant.

5. The applicant is reported to be unwell. The jail authorities shall ensure proper treatment for the applicant.
