Admittedly, the modification order of the previously executed transfer order has been stayed by this Court, which is operative for last about 2 years.

Shri Surana, learned Dy. Government Advocate appearing for the respondent State would submit that since the interim order is operative for last about 2 years, State shall not insist upon implementation of the impugned order, however, liberty may be reserved in favour of the State to pass fresh order depending upon the administrative exigency.

In view of the statement made, the writ petition is disposed of with direction that State shall not insist upon the implementation of the impugned order, however, they would be at liberty to pass fresh order as and when administrative exigency arises. Sd/- Judge Prashant Kumar Mishra Nirala
