Hon'ble Shri Justice P. Sam Koshy Order On Board 13.08.2018 The grievance of the petitioner is that the land belonging to the petitioner was acquired by the respondents for mining purpose in the year 2008. As per the rehabilitation policy that was prevailing at that point of

time, the petitioner was entitled for employment in lieu of the land which was belonging to him having been acquired. However, till date the claim of the petitioner has not been finalized by the respondents. 2.

Given the aforesaid factual matrix of the case, this Court intends to dispose of the writ petition with a direction to respondents 1 & 2 to immediately process the case of the petitioner and to pass a suitable order deciding whether the petitioner is entitled for employment or not. If the petitioner is entitled for employment, the same should be provided at the earliest and if he is not entitled, the petitioner should be intimated as to why he is not entitled for.

Let this exercise be done within a period of 4 months from the date of receipt of certified copy of this order. It is the responsibility of the petitioner to apprise the respondents 1 & 2 so far as the order passed by this Court is concerned.
