1. At the outset, learned counsel for the applicant submits that this bail application may be disposed of as not pressed as he intends to surrender before the concerned criminal court having jurisdiction and also intends to file an application under Section 437 of the Cr.P.C. The court below may be directed to dispose of the said application as early as possible.

2. As prayed, instant MCRCA is disposed of as withdrawn without any appreciation on its merit. If the applicant surrenders before the criminal court having jurisdiction and files an application under Section 437 of the Cr.P.C. after completion of entire procedural formalities, the court below having jurisdiction is directed to decide the same as expeditiously as possible.

3. Instant MCRCA is accordingly disposed of.
