MCRC No. 7971 of 2020 & MCRC No. 8490 of 2020 03/02/2021 :
1. The aforesaid bail applications are being disposed of by this common order as they arise out of Crime No.141/2020 registered in Police Station Tumgaon, District Mahasamund for offence under Section 394/34 of the IPC.
2. 6 accused persons committed loot of Rs.11,52,000/- from the Government liquor shop of Tumgaon on 17.10.2020. After the loot Rs. 8 lakhs was retained by Vijay Manhare, whereas applicant Yogesh Dhritlahre received Rs.75,000/- and applicant Amar Dhritlahre received Rs.70,000/-. Applicants Rahul Nande and Rajesh Jatwar were given Rs.25,000/- each, as they were not present on the spot but acted as informant prior to commission of crime.
3. Considering the role assigned to applicants Rahul Nande and Rajesh Jatwar and for the fact that they are in jail since 18.10.2020 and charge sheet has already been filed, I am inclined to release them on bail.
4. Accordingly, the application {MCRC No.7971/2020} is allowed and the applicants namely, Rahul Nande and Rajesh Jatwar are directed to be released on bail on each of them executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. They are directed to appear before the trial Court on each and every date given by the said Court.
5. Since the applicants Yogesh Dhritlahre and Amar Dhritlahre were present at the time of loot and had actually participated in the crime, the application {MCRC No.8490/2020} is rejected. Sd/- Judge (Prashant Kumar Mishra) Barve
