Shri Majid Ali, Dy. Govt. Advocate Hon'ble Shri Justice P. Sam Koshy Order On Board 24.08.2018 The grievance of the petitioner is that though the husband of the petitioner working with respondents 1 & 2 had died in harness on 03.08.2013 but till date she has not been granted compassionate

appointment.

Perusal of the record appears that under respondent no.2, the compassionate appointment is granted on the post of Shiksha Karmi Grade-III. However, since the petitioner was not 12th passed, she could not be considered for appointment on the post of Shiksha Karmi Grade-III. The petitioner in between preferred an application to the respondents for considering her claim for compassionate appointment on Class-IV category where the requirement of 12th pass may not be there and in fact the petitioner is 10th passed.

Given the said application by the petitioner for compassionate appointment on Class - IV post, this Court is of the opinion that let the respondents 1, 2 & 5 consider the claim of the petitioner for grant of compassionate appointment in any of the Class-IV category post available under them. Let the petitioner once again approach respondent no.2 within a period of 4 weeks from today by moving a detail application giving an undertaking that she is willing to accept a Class - IV category employment with respondent no.2. On such application being moved, let the respondents consider and decide the claim of the petitioner at the earliest preferably within a period of 90 days from the date of receipt of the application of the petitioner.
