NAFR HIGH COURT OF CHHATTISGARH AT BILASPUR WPS No. 5100 of 2018 Smt. Kanti Jaiswal W/o Shri J.S. Jaiswal Aged About 55 Years R/o Ashok Nagar, Bilaspur, Tehsil And District Bilaspur, Chhattisgarh Present R/o Village Lormi, District Mungeli, Tehsil And District Mungeli, Chhattisgarh ---- Petitioner
Versus
1. State Of Chhattisgarh Through The Secretary, Department Of Women And Child Welfare Department, Mahanadi Bhawan, Mantralaya, New Raipur, District : Raipur, Chhattisgarh
2. Collector, Mungeli, District Mungeli, Chhattisgarh
3. Sub Divisional Officer, Tahsil Lormi District Mungeli, Chhattisgarh
4. Smt. Maya Verma Working As Anganbadi Worker, Village Masna, Tehsil Lormi, District Mungeli, Chhattisgarh ----Respondents For Petitioner :
Mr. Devesh G. Kela, Advocate For State :
Mr. Dheeraj Wankhede, Govt. Advocate Hon'ble Shri Justice P. Sam Koshy Order on Board 21/08/2018
1. The challenge in the present writ petition is to the order (Annexure P/1) dated 23.07.2018, whereby the petitioner who was working as a Supervisor in the Women and Child Welfare department has been posted from Semarsal to Baigakapa.
2. Perusal of the impugned order would reveal that the said order is nothing but a distribution of the work by the Collector so far as the officers are concerned and which is well within the domain of the Collector.
3. Moreover what also cannot be lost sight is that the distance between the two places, where the petitioner was presently working and where she has now been posted is barely 15-16 KMs, which again is too short a distance for which this Court should invoke its
extra ordinary power under writ jurisdiction to scrutinize the order of posting.
4. The writ petition being devoid of merits deserves to be and is accordingly dismissed.
5. Needless to mention that according to the petitioner, she has raised various grievances in respect of the functioning at the earlier place of posting and has made complaints in this regard to the higher authorities, the authorities are expected to look into the same and take appropriate decision on the administrative side.
