This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicants who have been arrested in connection with Crime No. 46/2018 registered at Police Chouki-Bireijher, Police Station- Kurud District - Dhamtari C.G.) for the offence punishable under Sections 420, 466, 467, 468, 471, 472, 120-B of Indian Penal Code (for short 'IPC').

Learned counsel for the applicants submits that the applicants have been falsely implicated in this case. They are in jail since 5.2.2018. charge-sheet has been filed after completion of investigation. No case is made out against these applicants, hence, prayed that the applicants be enlarged on bail.

3. On the other hand, learned counsel for the State opposes the bail applications and the submission made in this respect. It is submitted that the fake seal of Revenue Officers have been recovered from the possession of applicant Khamhan Singh Rajput which has been used for preparation of forged revenue papers, hence, no case is made out for grant of regular bail in favor of the applicants.

4. Heard both the parties and perused the case diary.

5. It is a case in which the forged revenue papers were presented in bank by various persons who are accused in this case to obtain loan. The allegation against applicant No.1 is this that he was the person who used to supply forged documents and applicant No.2 was his associate. Hence, this case.

After due consideration on all the material present in the case diary and considering this fact that similarly placed co-accused persons have been granted regular bail by this Court and also for the reason that investigation in this case is complete, I am of this view that this is a fit case where the applicants should be enlarged on regular bail.

7. Accordingly, the bail application filed under Section 439 of Cr.P.C. is allowed. It is directed that the applicant shall be released on bail on furnishing a personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, for his
