1. This is an application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with Crime No.168/2020, registered at Police Station Rajpur Balrampur- Ramanujganj C.G. for the offence punishable under Section 379, 34 of the I.P.C.
2. As per the prosecution case, it is alleged that the present applicant along with co-accused Akash @ Lalla @ Shashidhar Pandey and Abhishek Pandey has committed theft of ₹50,000/- kept in a plastic bag in the dickey of
MCRC No. 7767 of 2020 motorcycle of complainant - Rehmuddin Ansari.
3. Admittedly, Akash @ Lalla @ Shashidhar Pandey and Abhishek Pandey have already been released on regular bail in MCRC No.7649 of 2020 and MCRC No.7655 of 2020 respectively.
4. Learned State counsel would oppose the prayer for grant of bail.
5. Considering the entire fact situation of the case, I am inclined to release the applicant on bail.
6. Accordingly, the application is allowed and the applicant is directed to be released on bail on executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
