1. This is an application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with Crime No.172/2020, registered at Police Station Rajpur Balrampur- Ramanujganj C.G. for the offence punishable under Section 380, 457, 34 of the I.P.C.

2. As per the prosecution case, the applicant has allegedly committed theft of ₹5000/- after committing house trespass in the house of complainant Shivanand Dubey.

3. Learned State counsel would oppose the prayer for grant of bail on submission that one more case of commission of theft and three more crimes of different nature have been registered against the applicant.

4. In one of the case bearing MCRC No.7767/2020, the present applicant has been released on bail today. Other cases are not about commission of theft.

5. Considering entire fact situation of the case, I am inclined to release the applicant on bail.

6. Accordingly, the application is allowed and the applicant is directed to be released on bail on executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
