Hon'ble Shri Justice Goutam Bhaduri Order On Board 19.11.2020 Heard

1. The grievance of the petitioner herein is in respect of the inaction on the part of the respondents, whereby the petitioner has been deprived the benefit of Agriculture Crop Insurance as per the scheme of the State Government under the "Pradhan Matri Fasal Bima Yojna".

2. As per the scheme, the amount was to be deducted by the respondents and the premium was to be paid to the concerned insurance company, however in the instant case the premium was neither being deducted, nor was it paid to the concerned insurance company and on account of which the petitioner has been deprived of getting the benefit of the damage/loss caused to the crops by way of Agriculture Crop Insurance.

Perusal of the writ petition would show that the District Collector, District Kabirdham has already conducted an inquiry and found that there were serious lapses on the part of the management of the society and the operator working in the said society. The District Collector has already vide his order Annexure P/6 dated 29.08.2020 made a correspondence with the respondent No.4 for taking appropriate recovery proceedings against the erring officials of the Society management and the petitioner be compensated suitably and also has suggested for taking disciplinary action against the erring officials, but no further development has since occurred.

Given the fact, let the petitioner file a fresh representation both before the respondents No.4 & 5 in the light of the order of the District Collector, District Kabirdham dated 29.08.2020 (Annexure P/6) within a period of 15 days from today and the respondents No.4 & 5 on due scrutiny of the claim of the petitioner and on verifying the facts shall take appropriate remedial measures keeping in view of the order of the District Collector dated 29.08.2020 and try to redress the grievance of the petitioner at the earliest preferably within a period of 120 days from the date of receipt of the representation of the petitioner.
