1. Heard.

2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.135/2019 registered at Police Station Lundra, District Sarguja (CG) for the offence punishable under Sections 147, 148, 149, 302, 323 of the IPC.

3. As per the FIR lodged by Vishnu Yadav, who is an eye-witness, as also in the statements of other eyewitnesses namely Girvar

MCRC No. 7721 of 2020 Yadav and Suresh Pawle, initially Sunil Singh assaulted the deceased by means of spade, but later on other accused persons including the present applicant had also taken part in the assault.

4. Considering the eye-witness account and that the bail application of similarly placed co-accused Sohar Singh has been dismissed by this Court vide order dated 11.8.2020 passed in MCRC No.1523 of 2020, this Court is not inclined to release the applicant on bail.

5. Accordingly, the bail application is rejected. However, liberty is reserved in favour of the applicant to move again after examination of the eye-witnesses.
