At the outset, learned counsel for the applicant is not pressing the application for grant of bail on merit but only praying for grant of bail on the ground of ill health of the applicant and he is not getting proper treatment in jail. 2.

Learned State counsel would submit that there is no reason why the applicant would not be provided proper treatment. Learned State counsel would also submit that proper direction may also be issued in this regard. 3.

Considering the submission, the application is dismissed as withdrawn. However, the Jail Authority is directed to ensure proper treatment of the applicant as even though the applicant is accused of having committed offence, while in jail he is entitled to proper treatment in case he has any disease or any health problem. 4.

With the aforesaid direction, the application is dismissed as withdrawn and if necessary and on the basis of report of treating doctor, the applicant may also be referred to Higher Medical Centre for proper check up. Sd/- (Manindra Mohan Shrivastava) Judge Rekha
