1. In this appeal filed under Section 374(2) Cr.P.C., the appellant has challenged the legality, validity and propriety of the judgment of conviction and order of sentence dated 01.06.2019 passed by the 2nd Additional Sessions Judge, District Korba, C.G. in S.T. No.57/2018, whereby and whereunder the appellant stands convicted and sentenced as under:- Conviction Sentence Under Section 306 of Indian Penal Code Rigorous Imprisonment for seven years and fine of Rs.200/-, in default of payment of fine amount to undergo additional rigorous imprisonment for two months
2. Counsel for the appellant submits that appellant Chameli Bai Halwai, W/o Raj Gopal Halwai has died on 07.10.2021. As per the report submitted by Jail Superintendent, Central Jail Bilaspur, C.G., it is evident that she has died on 07.10.2021. However, no application has been filed by the legal heirs of the deceased to prosecute this appeal.
