Hon'ble Justice Shri Gautam Chourdiya Order on Board 13/01/2021 1) This appeal by the accused/appellant under Section 14-A(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 is directed against the order dated 30/07/2020 passed by the Special Judge (S.C./S.T. Act), Jagdalpur, District Bastar (C.G.) in Bail Application No. 224/2020, refusing to allow his regular bail under Section 439 Cr.P.C. The appellant is in jail since 30/06/2020 in connection with Crime No. 105/2020 for the offence punishable under Sections 363, 366 & 376 of IPC, under Section 6 of POCSO Act and under Section 3 (2)(v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 registered at Police Station Nagarnar/AJAK, District Bastar (C.G.). 2) At the very outset, learned counsel appearing for the appellant seeks to withdraw this appeal with liberty to file afresh appeal at the appropriate stage.

3) Shri Kuldhar Nag, father of the prosecutrix appearing in person alongwith prosecutrix also raised objection to release of the appellant on bail.

4) Accordingly, the appeal is dismissed as withdrawn with the liberty as stated above.
