NAFR HIGH COURT OF CHHATTISGARH AT BILASPUR WPS No. 4653 of 2020 Sulbhaji S Azade S/o Late Shankar Rao Aged About 60 Years Posted As A Head Constable, C.I.S.F., B.S.P. Unit Bhilai, District Durg Chhattisgarh. ---- Petitioner

Versus

1.

Director General Of CISF CISF Complex, Lodhi Road, New Delhi. 2.

Commandant CISF, BSP Unit, Bhilai, District Durg Chhattisgarh. ---- Respondents For Petitioner :

Mr. B.P. Singh, Advocate along with Mr. Sikhar Bakhtiyar, Advocate For Respondents :

Mr. Rajkumar Gupta, Advocate Hon'ble Shri Justice P. Sam Koshy Order on Board 03/12/2020 1.

The present writ petition has been filed not assailing any particular order, but requesting for an appropriate directions to the respondents to transfer the petitioner to his home station at Thal, Alibagh, Maharashtra.

2.

Learned counsel for the respondents submits that he has instructions to state that the petitioner was in fact only recently brought out of his home district after posting of a complete 4 years tenure at his home district from 01.05.2015 to 31.03.2019 and he has from 01.04.2019 posted at Bhilai. It was also the contention that the normal tenure at the present place of posting has not been completed. It was further the contention of the learned counsel for the respondents that the petitioner in the past have also made two

representations to the authorities in the Department and both these representations have already been rejected.

3.

Given the aforesaid facts and circumstances of the case, particularly taking note of the fact that the petitioner has been recently posted for a complete tenure of 4 years at his home station between 2015 to 2019 and from 2019 since he is only posted at Bhilai, which again is not quite far from his home district, this Court does not find any strong case made out by the petitioner for issuance of any specific direction to the respondents. The writ petition accordingly fails and is rejected.
