1. The applicant is arrested in connection with Crime No.82/2020 registered in Police Station- Raghunathnagar, District- Balrampur-Ramanujganj (CG) for alleged commission of offence under Section 302 IPC.

2. Case of the prosecution, in brief, is that applicant murdered his wife.

3. Learned counsel for the applicant would submit that the applicant has been falsely implicated in the alleged commission of offence. He submits that in a quarrel between the husband and wife, suddenly, the wife collided with the door and she sustained injury and died. Learned counsel for the applicant submits that in the query, the doctor has said that the injury could be caused by collision with the door. Therefore, the applicant may be released on bail.

4. On the other hand, learned counsel for the State opposed the bail application

-2by submitting that the deceased sustained fatal injury on her head which shows that she had sustained injury by a hard and blunt object with force so much so it resulted in internal injury to the brain and death.

5. Taking into consideration the submissions made by learned counsel for the parties, taking into consideration that the deceased was found dead in her own house, there being no other person stated to be present in the house, I am not inclined to allow the application.

6. The application is accordingly rejected.
