Mr. Somkant Verma, Advocate For Respondent/ State :
Mr. P. Acharya, Panel Lawyer Hon'ble Shri Justice Goutam Bhaduri Order on Board 30.07.2019 Heard 1.
The grievance of the petitioner is that the petitioner has been transferred by order dated 12th July, 2019 to accommodate respondent no.4 Smt. Meera Sahare whose transfer has been effected on her own request. Learned counsel for the petitioner submits that that the petitioner is at the place of posting since last two years and the petitioner has moved an application/representation before the Collector vide Annexure P-5 which is pending adjudication and the petitioner has not yet been relieved, therefore, till the representation is decided, the transfer order with respect to petitioner may not be given effect to.
2.
A perusal of the transfer order would show that respondent no.4 Smt. Meera Sahare has been transferred on her own expenses meaning thereby she has been shifted on her own request in place of the petitioner. 3.
Considering the facts situation and back ground of the case, it is directed that since the petitioner had made a representation before the Collector, the Collector may decide the same within a further period of 30 days from the date of receipt of the copy of this order and in the meanwhile, the transfer order so far as it relates to the petitioner may not be given effect to. 4.
With the above observation/direction, this writ petition stands finally disposed of. Sd/- (GOUTAM BHADURI) JUDGE Rao
