1. This is first bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No. 312/2016 registered at Police Station Urla, Raipur, Distt. Raipur (C.G) for the offence punishable under Sections 294, 323, 327, 506-B read with section 34 of IPC.

As per the prosecution case, a report was made by one Vasant Kumar Uike that on 24.12.2016 while he was going to his home at that time he met with Rakesh Bharat, present applicant Ajay Tandon and one friend who pushed him and thereafter demanded Rs.1000 which he refused. Having refused to give the money, he was abused and also assaulted by hands and fists and accused Rakesh Bharat who was having holding bottle in his hand assaulted on his head and when it was intervened by other persons Prakash Sahu and Ravi Sahu, they were also assaulted.
3. Learned counsel for the applicant would submit that on trivial
issue the dispute has occurred, the injuries are simple in nature; charge sheet has been filed and no further investigation is necessary, therefore, the applicant may be enlarged on bail.
4. Per contra, learned State Counsel opposes the bail.
5. Perused the case diary statements and the medical report.
6. Considering the facts and circumstances of the case especially the fact that the injuries appears to be simple in nature, charge sheet has been filed and the applicant is stated to be in jail since 25.12.2016, I am inclined to allow this bail application.
7. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on executing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court for his appearance before the said Court as and when directed.
