The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 291/2014 registered in Police Station Urga Distt. Korba (CG) for offence punishable under section 304 of Indian Penal Code.

It is a case of bail jump. The applicant was initially enlarged on bail on 22/08/2014. Thereafter, trial commenced. He did not appear on 2/03/2015 and arrest warrant was issued. Consequently, he was arrested on 5/02/2017.

Learned counsel for the applicant submits that the applicant is a labour and there was some mis-communication, the applicant had gone to other State for his livelihood and the applicant is in jail since 5/02/2017, therefore the applicant may be released on bail. 4.

Learned State counsel opposes the prayer for grant of bail. 5.

Considering the facts and circumstances of the case and also the fact that applicant was earlier enlarged on bail and he is in jail since

5/02/2017, this court is inclined to release the applicant on bail. 6.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
