1. I.A. No.1, which is an application for exemption from filing another copy of Annexure P-1, is allowed.
2. Heard the matter finally at the admission stage, with the consent of the parties.
3. Challenge in the present writ petition is to the order dated 12.7.2019 (Annexure P-1) whereby the petitioner has been transferred from Government Middle School, Manoharpur, Block Udaipur, District Surguja to Government Middle School, Raikera, Block Sitapur, District Surguja.
4. The ground of challenge is that the petitioner has been posted at Manoharpur in just few a year back. In addition, the petitioner also submits that the only child of the petitioner is suffering from sever sickle cell disease and requires constant medical assistance and the close hospital is at Ambikapur which is closure to the present place of posting of the petitioner and in case of transfer of the petitioner from the present place of posting he will face great difficulty in getting medical assistance to his child in case of emergency.
5. Given the said fact, let the petitioner make an appropriate representation to respondent no.2 within a period of 10 days from today and the respondent no.2 in turn shall consider the representation and the contents raised in the
said representation and pass a speaking order within a period of 30 days from the date of receipt of representation. Till a decision is taken by respondent no.2, there shall be a stay of the effect and operation of the impugned order (Annexure P-1) so far as the petitioner is concerned.
