1. This is first bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicants in connection with Crime No. 24/2017 registered at P.S. Saraswati Nagar, Distt. Raipur (C.G) for the offence punishable under Section 34(2) of the C.G. Excise Act.

2. As per the prosecution case, on a raid being conducted on 13.02.2016, from the possession of the applicant 8.640 bulk litres of illegal liquor was seized.

3. Learned counsel for the applicant would submit that the applicant has been falsely implicated and no seizure was made in person from the applicant. He further submits that the charge sheet has been filed and the applicant is in jail since 14.02.2017, therefore, he may be enlarged on bail.

4. Per contra, learned State Counsel opposes the bail and submits that as many as 27 cases stand registered against the applicant including 7 cases of Excise and other cases

under different sections of IPC.

5. Considering the past antecedents of the applicant as according to the learned State Counsel, 27 cases have been registered to the credit of applicant, I am not inclined to release the applicant on bail. Accordingly, this bail application is rejected.
