1. This is first bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicants in connection with Crime No. 24/2017 registered at P.S. Bilaigarh, Distt. Baloda Bazar - Bhatapara (C.G) for the offence punishable under Section 20(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

2. As per the prosecution case, on 18.01.2017 the police had received a secret information that the applicant was keeping contraband Ganja in her house upon which a raid was conducted in the house of applicant. It is alleged that on search being made, from the possession of the applicant, 2 Kgs., of Ganja was recovered.

3. Learned counsel for the applicant would submit that the the seizure was not made in person from the applicant and she has been falsely implicated. He further submits that the charge sheet has been filed and the applicant is a lady and is in jail since 18.01.2017, therefore she may be enlarged on

bail.

4. Per contra, learned State Counsel opposes the bail.

5. Considering the quantity of Ganja which is 2 Kgs., and the nature of recovery as also the fact that the charge sheet has been filed and the applicant is in jail since 18.01.2017, I am inclined to release her on bail.

6. Accordingly the bail application is allowed and the applicant is directed to be released on bail on executing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the trial Court for her appearance before the said Court as and when directed.
