The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.185/2016 registered in Police Station Jhagrakhand, Distt. Koriya (C.G.) for offence punishable under section 379, 387, 436/511 of Indian Penal Code read with Section 66 of IT Act.

Case of the prosecution, in brief, is that a report was made by T.P. Singh on 16/11/2016 that certain papers were stolen from the dickey of the motorcycle and in lieu thereof certain demand were made on mobile No.9424253052 from two mobile Nos. i.e. 9522806239 and 9522504083 and Rs. 5 lakhs were demanded in lieu of the papers and thereafter mobile were seized.

Learned counsel for the applicant submits that both mobile numbers which were alleged to be seized belong to one Sachin Pandey whose statement has not been recorded and it is dispute in between munshi the applicant and the complainant who was contractor and it is
virtually impossible to recognise the voice of the employee and they were working together, no statement of Sachin Pandey was recorded, whether existence of Sachin Pandey is there or not, charge sheet has been filed, therefore the applicant may be released on bail. 4.
Learned State counsel opposes the prayer for grant of bail. 5.
Perused the case diary and the documents. At the instance of the applicant two phones were seized bearing No. 9522806239 and 9522504083 wherefrom call and message were made and money was demanded. Considering the evidence collected, this court is not inclined to release the applicant on bail.
