Sam Koshy Order On Board 23.08.2018 The dispute raised by the petitioner in the present writ petition is that though her husband working as a Deputy Superintendent in the Industries Department died in harness on 11.07.2014 but till date the death-cum-retiral dues and pensionary benefits have not been released to her and if at all if it has been released, only paltry amount has been released and that too without interest for the delay caused.

Considering the entire facts and circumstances of the case and also taking note of the fact that the petitioner is a widow and her husband had died four years back, this Court does not intend to keep the petition pending by admitting the same rather ends of justice would meet if the writ petition is disposed of with a direction to respondents 1 & 2 to take a proper decision ensuring that the entire dues payable to the petitioner on the death of her husband is paid to her at the earliest preferably within a period of 3 months from today. In addition, the petitioner would be at liberty to file a detail representation to respondent no.1 giving description of the entire payment whatsoever she has received.
