1. It is contended that the petitioner is working at Primary Health Centre, Lahpatra, Block Lakhanpur as a Lab Technician and vide order dated 12.07.2019, he has been transferred from Lahpatra to Community Health Centre, Dhourpur, Block Lundra.

2. Learned counsel for the petitioner refers to Annexure P-3 and submits that at Dhourpur only two sanctioned post of Lab Technician exist and both the posts are filled and there is no vacancy. He submits that at

-2Lahpatra, there is only one sanctioned post of Lab Technician and if the petitioner is transferred, the post of Lab Technician shall be vacant.

3. Perused the document as also Annexure P-3 which shows that there are two sanctioned post of Lab Technicians at Dhourpur and two persons are working on the said post.

4. Taking into consideration the documents filed along with the petition particularly Annexure P-3, it is directed that the petitioner may make a representation to the Grievance Redressal Committee constituted by the State against the transfer within a period of 15 days from today and the Grievance Redressal Committee may decide the same within a further period of 30 days from the date of receipt of the representation. Till the representation of the petitioner is decided, the transfer in respect of the petitioner shall not be given effect to.
