Hon'ble Shri Justice Goutam Bhaduri Order on Board 31.07.2019

1. The petitioner in the present writ petition is aggrieved by the order dated 12.07.2019, whereby the petitioner has been transferred from Primary School, Basik, Katghora to Primary School, Fertilizer, Darri, District Korba.

2. Learned counsel for the petitioner submits that the petitioner is a widow lady and suffering from certain ailments. Further, no proper transport facility is available at the transferred place and therefore the impugned transfer order may be cancelled. The petitioner may be given liberty to make a representation to the Committee which has been constituted by the State Govt. vide order dated 11.07.2019, wherein the grievance of the transfer is being heard.

3. The State counsel opposes the petition on the ground that distance between the two is only 30 KM.

4. Considering the facts and circumstances of the case and also taking into consideration the fact that petitioner is a widow and one Committee has already been constituted by the State, it is directed that the petitioner may

make a detailed representation bringing all these facts and grievances, in addition to the representation that she has already made, along with all relevant documents before the Committee within a period of 15 days from today, who in turn, shall consider and decide the same at the earliest preferably within a further period of 45 days.
