The applicant has preferred this first bail application under Section 439 of the Cr.P.C. for grant of bail as he has been arrested in connection with Crime No.113/2018, registered at Police Station Kusmi, Balrampur-Ramanujganj (CG), for the offence under Sections 302 & 201 read with Section 34 of the Indian Penal Code.

Present applicant and co-accused Ramparvesh Singh have committed murder of Ramvilas (since deceased) in between

14-10-2018 to 20-10-2018. The deceased started from his house on 14-10-2018 after receiving phone call from co-accused Ramparvesh and could not be traced thereafter. A missing report was lodged on 18-10-2018 and thereafter his dead body was found in a ditch behind the passenger waiting room at village Devsara near Chawrikona Nala. Case of the prosecution is based on circumstantial evidence. Co-accused Ramparvesh Singh has already been released on bail by a coordinate Bench of this Court by order dated 21-10-2019 passed in M.Cr.C.No.3814 of 2019.

Having considered the facts situation of the case and for the fact that the similarly placed co-accused Ramparvesh Singh has already been released on bail, I am of the opinion that present is a fit case to release the applicant on regular bail.

Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
