Versus
• State Of Chhattisgarh Through Station House Officer , Police Station Dongargarh District Rajnandgaon Chhattisgarh ---- Respondent For Applicant :
Shri Vivek Sharma, Advocate For Respondent/State :
Ms. Sunita Jain, GA Hon'ble Shri Justice Goutam Bhaduri Order 16/12/20
1. Heard.
2. This is the Second Bail Application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested on 06.02.2020 in connection with Crime No. 505/2019 registered at Police Station Dongargarh, District Rajnandgaon (CG) for the offence punishable under Sections 420, 467, 468, 471/34 & 120 B of Indian Penal Code.
3. The first bail application bearing M.Cr.C. No.1374 of 2020 was dismissed on 13.05.2020.
4. As per the prosecution case, while loan under Kisan Credit Card was being advanced by Punjab National Bank, certain documents of land were deposited and when the default was committed, notices were given by the bank officers it was found that false personification and false documents have been made and the allegation has been attributed to the present applicant as he was the mastermind and even in the name of deceased persons the document were prepared and loan was taken.
5. Learned counsel for the applicant submits that the other co-accused person namely Raman Robinson has been enlarged on bail by the Co-ordinate Bench. He would further submit that on the earlier occasion the bail was dismissed on the ground that the investigation was going on but now the charge-sheet has been filed, therefore, the applicant may be released on bail.
6. Per contra, learned State counsel opposes the prayer for grant of bail.
7. Considering the fact that the charge-sheet has already been filed and taking into the nature of allegation as also that the earlier bail application has been rejected by this Court on 13.05.2020 and after filing of charge-sheet this bail is directly preferred before this Court, I am not inclined to release the applicant on bail.
8. Accordingly, the bail application is dismissed. However, the applicant is at liberty to file the bail application before the trial Court as the charge-sheet has already been filed.
