The challenge in the present Writ Petition is to the order Annexure-P/1 whereby the petitioner has been transferred from District Durg to Kondagaon.

The counsel for the petitioner submits that the petitioner is around 61 years of age and he has got only 13 months left as he has to retire on 30/09/2019. He submits that, at this ripe age of his career, if the petitioner is subject to transfer to so far a distance, the entire family of his would get disturbed and he would also find difficult in getting the retiral dues promptly.

In addition, the counsel for the petitioner also submits that, the petitioner also suffers from heart disease and had to undergo a surgery about 2-3 years back and stands on medication of the hospital at Durg. 4.

Considering all the aforesaid facts and circumstances of the case, this Court directs the petitioner to make a detailed representation to the respondents in addition to the representation which the petitioner has made vide Annexure-P/5 dated 02/08/2018 and if so required, he may file another fresh representation within a period of 10 days from the date of receipt of the copy of this order. That in turn the authorities concerned particularly the respondent No.1 may scrutinize the case of the petitioner and the contentions that he has raised in his representation and decide the same within a further period of 8 weeks'. However till the representation is decided, the impugned order so far as the petitioner is concerned shall not be given effect to.
