The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.523/2016 registered in Police Station Janjgir District Janjgir-Champa (CG) for offence punishable under sections 498(A), 325 and 506 (B) of Indian Penal Code. 2.
As per the prosecution case, a report was made by Smt. Savitri Suryawanshi on 8/12/2016 that she was married to the applicant prior to 1 1⁄2 years of the incident, however she was subjected to torture and was physically assaulted and on 13/11/2016 she was assaulted whereby she suffered fracture on her wrist, thereafter she was forcefully kept in a room and no treatment was provided. However, she fled away and reported the matter.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case because of dispute in between the husband and wife, therefore the applicant may be released on bail. 4.
Learned State counsel opposes the prayer for grant of bail.

Perused the statement of the victim wherein it is stated that she suffered fracture, she was kept in captivity in a room and no treatment was provided, thereafter she could escape and reported the matter. Considering such statement, this court is not inclined to release the applicant on bail.
