1. This is an application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with Crime No.220/2020, registered at Police Station Balod, District Balod C.G. for the offence punishable under Section 307 & 302 of the I.P.C.

2. Applicant has committed murder of her husband by setting him ablaze in the early morning at about 05:15 am on 28.06.2020. In addition to dying declaration and diary

MCRC No. 7977 of 2020 statement of the deceased, Megha Sahu, daughter of deceased, aged about 15 years has also informed the Police that immediately after the incident deceased had made oral dying declaration to them to the effect that the present applicant has set him ablaze.

3. Learned State counsel would oppose the prayer for grant of bail.

4. Considering the evidence available on record, I am not inclined to release the applicant on bail.
