Heard the matter finally.

Learned counsel for the applicant would submit that the applicant is arrested on 01-09-2016 by Jamul police, District Durg, C.G. in connection with Crime No.52/2015 for the offence under Section 420/34 of the IPC which is pending before the JMFC Durg, C.G. as Criminal Case No.9336/2016. The learned counsel for the applicant would submit that co-accused was granted bail in the matter and the present matter is of civil nature. Hence, bail may be granted to the present applicant.

Per contra, learned counsel for the non-applicant/State would submit that the applicant purchased wire 33.710 metric ton and gave cheque of more than Rs.15,78,818/- which was not honoured and bounced and thereafter also the applicant not paid the money which goes to show that the matter is not a civil litigation and the applicant is the main accused. 4.

Perused the entire matter.

On due consideration, as there is no steps taken after the cheque bounce on behalf of the applicant towards the purchase amount as he already purchased 33.710 metric ton of the wire, I am not inclined to grant bail to the
