The grievance of the petitioners in the present writ petition seems to be the gradation list that has been prepared where the petitioners are being shown junior to the persons similarly placed in the district. 2.

Perusal of the pleadings would show that the petitioners were initially appointed at District Rajnandgaon and subsequently on their request they have been transferred to District Durg and when the gradation list was published, the name of the petitioners have been shown giving them the bottom seniority.

The contention of the petitioners is that as regards the other range in the Police Department in the State of Chhattisgarh, the gradation list is being prepared exclusively taking into consideration the date of appointment and therefore the petitioners have made a representation to the authorities in this regard. 4.

Prima-facie this Court is of the opinion that since the petitioners admit to have come from District Rajnandgaon to Durg on their own request and in the Durg district, they have been given the bottom seniority. The same seems to be in accordance with the guidelines and circulars and Rules governing the field of seniority. However, in case if the petitioners still are aggrieved of the decision, they have every right to make a representation to the respondents No.2 & 3 and if the petitioners make suitable representation in addition to the representation, which they have already been made, the respondents may consider and decide the same on its own merits in accordance

with the Rules and circulars governing the field particularly circulars dealing with seniority upon inter-district transfer being made. 5.

With the aforesaid observations, the present writ petition stands disposed of.
