This is second bail application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested on 21.05.2017 in connection with Crime No. 638/2013 registered at Police Station- Sector-6, Bhilai Nagar, Bhilai, District-Durg (C.G.) for the offence punishable under Section 363, 366 & 376 of IPC. 2.

Earlier, the first bail application was rejected by this Court on 27.11.2017. The age of the prosecutrix was 14 years & 1 month on the date of incident and there is no change in circumstances as no one examined before the trial court.

In absence of change in circumstances, it is not a fit case to grant bail in favour of the applicant. I am not inclined to grant regular bail in favour of the applicant.

Accordingly, the bail application filed under Section 439 of the Cr.P.C. is rejected.
